By installing and using the demo version of the HTML Grinder and the accompanying materials and documentation (the "Software"), you acknowledge that you have read and received this Software License Agreement (the "Agreement"), and that you agree to be bound by it. If you do not wish to enter into this Agreement, you may delete the Software and all copies you may have made of it within 30 days of receiving the Software.
Upon your acceptance of this Agreement, Matterform Media grants you a nonexclusive license to use the Software, provided that you agree to the following:
Copyright protection
The Software is owned by Matterform Media and is copyrighted with all rights reserved. The Software may not be copied, in whole or part, without the written consent of Matterform Media except in the normal use of the software or to make a backup copy of the software, or to install and use the software on a secondary computer which is used exclusively by the same individual who uses the primary computer and which will not be used at the same time as the primary computer, or to install the software in demonstration mode and without any serial numbers on the computer of a third party for evaluation purposes only.
Restrictions
You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Software.
Limited warranty and disclaimer of warranty
Even though Matterform Media has tested the Software and reviewed the documentation, Matterform Media makes no warranty or representation, either express or implied, with respect to the Software, its quality, performance, merchantability or fitness for a particular purpose. This software is sold ﾒAs Is,ﾓ and you, the purchaser, are assuming the entire risk as to its quality and performance. In no event will Matterform Media be liable for direct, indirect, special, incidental or consequential damages or data loss resulting from any defect in the Software or its documentation.
Limitation of remedies
In no event will Matterform Media be liable to you for any consequential, incidental, or special damages, including but not limited to any lost data, revenues, profits, or savings, even if Matterform Media has been advised of the possibility of such damages, or for any claim by any third party.
Governing Law and General Provisions
This Agreement will be construed under the laws of the state of New Mexico. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permitted, and the remainder will remain in full force.
